Know Your Rights to Get the Best Recovery Possible

In Massachusetts, if you are injured on the job you may qualify for Workers' Compensation benefits.  This can include when driving a commercial vehicle or at a construction site.  Workers' Compensation benefits can pay both your medical bills and lost wages.

If you qualify for Workers' Compensation benefits, you will not be able to sue your employer for bodily injuries related to the incident that caused your injuries.

However, there are many times when you will still have third party claims for bodily injuries against anyone other than your employer who caused or contributed to your injuries.

For instance, you can be struck by another vehicle while driving a work vehicle.  You could also be injured by another contractor at a construction site.

Under Massachusetts law, G.L. c. 152, s. 15, the Workers' Compensation insurer is entitled to be paid back for any benefits they pay if you receive a third party recovery.  This is an administrative process that requires a petition (often called a Section 15 petition) be filed and approved by an administrative law judge at the Department of Industrial Accidents.
